1. BUSINESS APPOINTMENT APPLICATION: 皇冠体育app Rt Hon Michael Gove, former Secretary of State for the Department for Levelling up, Housing and Communities. Paid appointment with 皇冠体育app Spectator.
You approached the Advisory Committee on Business Appointments (the Committee) under the government鈥檚 Business Appointments Rules for Former Ministers (the Rules) seeking advice on taking up a paid role as Editor with 皇冠体育app Spectator.
皇冠体育app purpose of the Rules is to protect the integrity of the government. 皇冠体育app Committee has considered the risks associated with the actions and decisions made during your time in office, alongside the information and influence you may offer 皇冠体育app Spectator. 皇冠体育app material information taken into consideration by the Committee is set out in the annex.
皇冠体育app Committee鈥檚 advice is not an endorsement of the appointment 鈥� it imposes a number of conditions to mitigate the potential risks to the government associated with the appointment under the Rules.
皇冠体育app Ministerial Code sets out that ministers must abide by the Committee鈥檚 advice. It is an applicant鈥檚 personal responsibility to manage the propriety of any appointment. While carrying out your ministerial role[footnote 1], you were speaker at events organised by the Spectator and interacted with its journalists in the discharge of ministerial duties. You were not involved in any policy discussions or decisions relating to the magazine or its parent company. You also spoke with representatives of other newspapers and news agencies. Media policy and regulation sat outside of your responsibilities and you made no decisions specifically related to 皇冠体育app Spectator. 皇冠体育app Committee[footnote 2] considered the risk you could be seen to have been offered this role as a reward for decisions made, or actions taken in office, was low.
As a former Cabinet Minister, there are inherent risks associated with your privileged access to information, influence and contacts which may be seen to be of general use to any media company. 皇冠体育app risk associated with your access to information is limited given the transparent nature of this role with a magazine. Further, you have told the Committee that you will not work on commercial business matters for the Spectator, nor lobby government.
3. 皇冠体育app Committee鈥檚 advice
皇冠体育app Committee did not consider joining 皇冠体育app Spectator as Editor to raise any particular concerns under the government鈥檚 Rules, provided it is subject to the conditions below. However, the Committee reminds you that it is your responsibility to manage the propriety of any work undertaken with 皇冠体育app Spectator. In particular, as a former Cabinet minister, you must be careful not to offer any unfair insight as a result of your access to information and potential influence in government 鈥� which the conditions below seek to mitigate.
In accordance with the government鈥檚 Business Appointment Rules, the Committee advises this role with the 皇冠体育app Spectator be subject to the following conditions:
鈼� a waiting period of three months from your last day in ministerial office;
鈼� you should not draw on (disclose or use for the benefit of yourself or the persons or organisations to which this advice refers) any privileged information available to you from your time in ministerial office;
鈼� for two years from your last day in ministerial office, you should not become personally involved in lobbying the UK government or its arm鈥檚 length bodies on behalf of 皇冠体育app Spectator (including parent companies, subsidiaries, partners and clients); nor should you make use, directly or indirectly, of your contacts in the government and/or ministerial office to influence policy, secure business/funding or otherwise unfairly advantage 皇冠体育app Spectator (including parent companies, subsidiaries, partners and clients); and
鈼� for two years from your last day in ministerial office, you should not undertake any work with 皇冠体育app Spectator (including parent companies, subsidiaries, partners and clients) that involves providing advice on the terms of, or with regard to the subject matter of a bid with, or contract relating directly to the work of, the UK government or its arm鈥檚 length bodies.
皇冠体育app advice and the conditions under the government鈥檚 Business Appointment Rules relate to your previous role in government only; they are separate from rules administered by other bodies such as the Office of the Registrar of Consultant Lobbyists, the Parliamentary Commissioner for Standards and the Registrar of Lords鈥� Interests.[3] It is an applicant鈥檚 personal responsibility to understand any other rules and regulations they may be subject to in parallel with this Committee鈥檚 advice.
By 鈥榩rivileged information鈥� we mean official information to which a minister or Crown servant has had access as a consequence of his or her office or employment and which has not been made publicly available. Applicants are also reminded that they may be subject to other duties of confidentiality, whether under the Official Secrets Act, the Ministerial Code or otherwise.
皇冠体育app Business Appointment Rules explain that the restriction on lobbying means that the former Crown servant/minister 鈥榮hould not engage in communication with government (ministers, civil servants, including special advisers, and other relevant officials/public office holders) 鈥� wherever it takes place - with a view to influencing a government decision, policy or contract award/grant in relation to their own interests or the interests of the organisation by which they are employed, or to whom they are contracted or with which they hold office鈥�.
You must inform us as soon as you take up employment with this organisation, or if it is announced that you will do so. You must also inform us if you propose to extend or otherwise change the nature of your role as, depending on the circumstances, it may be necessary for you to make a fresh application.
Once the appointment has been publicly announced or taken up, we will publish this letter on the Committee鈥檚 website, and where appropriate, refer to it in the relevant annual report.
4. Annex - Material information

You wish to take up a paid, full-time, role as Editor of 皇冠体育app Spectator. 皇冠体育app Spectator is an established magazine published weekly, covering politics and culture. You said that the role will not include lobbying government, nor any aspect of the corporate or commercial aspects of the organisation - responsibility for which will sit with the publisher.
You said you had previously worked as a journalist prior to your career in politics.
4.2 Dealings in office
You said that you had spoken at events organised by 皇冠体育app Spectator, and interacted with its journalists in the discharge of your ministerial duties. You made no relevant policy or commercial decisions; and you did not have access to information that could provide an unfair advantage.
4.3 Departmental assessment
