TRSM50030 - Trustee data retention obligations: contents: how long the information must be retained by professional trustees

Where trustees are being paid to act as trustees of a trust, they must retain the records holding the information specified in TRSM50020 for five years after the date on which the final distribution is made under the trust.

»Ê¹ÚÌåÓýappse trustees should then arrange for the records to be deleted or destroyed at the end of that period unless:

  • »Ê¹ÚÌåÓýapp trustees are required to retain them by or under an enactment
  • »Ê¹ÚÌåÓýapp trustees are required to retain them for the purposes of court proceedings
  • »Ê¹ÚÌåÓýapp trustees have reasonable grounds for believing that the records containing the personal data need to be retained for the purpose of legal proceedings
  • »Ê¹ÚÌåÓýapp person to whom the information relates consents to the retention of the information
